STATE AND LOCAL LAWS AND REGULATIONS. VOID
WHERE PROHIBITED BY LAW. By entering the CareerBuilder.com
Magic Job Contest (the "Contest") entrants agree to be bound by these
Official Contest Rules and Regulations ("Rules"). The Contest
commences at 12:00 a.m. Eastern Time ("ET") on January 8, 2008 and ends at
11:59:59 p.m. ET on January 27, 2008 (the "Contest Period"). Sponsor: The Contest is sponsored by CareerBuilder, LLC
("Sponsor"), Eligibility: The Contest is offered and open only to legal
residents of the fifty United States and the District of
Columbia who are eligible to work in the fifty United States and the
District of Columbia, age 21 and older as of the date of entry, who have a
valid E-mail address. The Contest is not
open to: (1) employees, independent
contractors, officers, and/or directors of Sponsor, Disney Destinations,
LLC ("Disney Destinations"), Sponsor's and Disney Destinations' respective
parent, related, affiliated and/or subsidiary companies, Sponsor's advertising,
promotion and fulfillment agencies or Sponsor's legal advisors, (2) the 25
winners of the CareerBuilder.com 2007 Dream Job Contest or (3) the immediate family
members of, and persons living in the same household as, any of the foregoing persons.
Any person who has been convicted of, or
pleaded guilty to, a crime may not be eligible to win. How
to Enter: Visit http://www.dreamcmo.com
during the Contest Period and submit an Official Entry form including your
complete name, address including zip code, telephone
number, your primary e-mail address and answers to other questions on
the Official Entry form, and upload a video application not to exceed sixty (60)
seconds in length /100 MB in AVI, .MOV, or .MPG file format (collectively
"Online Entry"). Online Entry must include the entrant's explanation of why
he/she is the perfect candidate for the position of Chief Magic Official ("CMO").
Content of Online Entry video clip is
limited to an audio commentary by entrant describing why he/she would be the perfect
candidate for the position of CMO. Music
cannot be included in any Online Entry submitted. Any Online Entry submitted
with music will be disqualified. The
presence of children in the video clip is allowed, but only if entrant is the parent
or legal guardian of such children. No
previously published video clips may be submitted nor will such a submission
qualify as an Online Entry. All Online
Entries become the sole property of the Sponsor and will not be acknowledged or
returned. No correspondence will be
entered into, acknowledged or returned. Sponsor
reserves the right to edit, publish and use any Online Entry without further
permission, consideration or payment to the entrant. By submitting an Online Entry, entrant
warrants and represents that Online Entry is 100% original creation/work
by entrant and that use of the Online Entry as described herein will not
violate any law or infringe upon the rights of any third party. All Online
Entries must be received by 11:59:59 PM ET on January 27, 2008. Limit one
Online Entry per person. Duplicate Online Entries received will be void. In the event the same video clip is submitted
by more than one entrant, the first Online Entry received will be accepted and
all additional duplicate Online Entries will be deemed void. Use of automated devices is not valid for entry. Online Entries must include a valid e-mail
address for the entrant. Sponsor and Disney
Destinations and their respective parent, related, affiliated and subsidiary
companies, advertising, promotion and fulfillment agencies and legal advisors
and their respective officers, directors, agents, employees, and assigns (collectively,
the "Released Parties") are not responsible for any problems or technical,
hardware, or software malfunctions of any telephone network or telephone lines,
failed, incorrect, inaccurate, incomplete, garbled or delayed electronic
communications whether caused by the sender or by any of the equipment or
programming associated with or utilized in this Contest, computer online
systems, servers or providers, computer equipment, software, failure of any e-mail
or entry to be received by the Sponsor due to technical problems, human error
or traffic congestion, unavailable network connections on the Internet or at
any website, or any combination thereof, including, without limitation, any
injury or damage to entrant's or any other person's computer relating to or
resulting from participating in this Contest or downloading any materials in
this Contest. If an entrant elects to receive future communications from Disney
Destinations and its affiliated companies about the Walt Disney World®
Resort, and other Disney products and services by placing a
mark within the associated box on the Official Entry form, such entrant's
information will be shared with Disney Destinations and its affiliated
companies. By submitting an Online Entry, you
agree to abide by the terms of these Rules, the terms of the CareerBuilder Terms and Conditions,
and the CareerBuilder Privacy
Policy. "Top 20" Judging
Criteria: Online Entries that
include profanity, inappropriate or explicit language or demonstrate any lewd
or sexually suggestive gestures or full or partial nudity will be disqualified.
A
total of up to twenty (20) "Top 20" Finalists will be selected from among all
Online Entries received. The "Top 20"
will be selected based on the following judging criteria: Entertainment Value (0-20 points); Personality
(0-20 points); Imaginative Presentation (0-20 points); Ability to Make People
Laugh and Smile (0-20 points); and Passion for Disney (0-20 points). The judging of Online Entries will be
conducted by CareerBuilder.com and Disney Destinations, whose decisions are
final and binding in all respects relating to the selection of all "Top 20" Finalists.
In the event of a tie, the tied Online Entries will
be re-judged by an additional judge selected by CareerBuilder.com and
Disney Destinations who will serve as the tie-breaker
using the same criteria as outlined herein. In the event an
insufficient number of qualified Online Entries is received (as determined by
the judges), this Contest may be cancelled. All "Top 20" Finalists will be
notified by e-mail, and overnight mail on or about February 7, 2008. If a "Top 20" Finalist's notification is
returned as undeliverable, such "Top 20" Finalist's Online Entry will be disqualified. The "Top 20" Finalists will need to complete
a personal background information form (that includes, among other things, the
"Top 20" Finalist's Social Security number (to be provided directly to
Sponsor's agent Centra Marketing & Communications, LLC ("Centra")), permission
to conduct a criminal background check and availability to participate in a
telephone interview with a representative of Disney Destinations), to be
completed and returned by February 10, 2008. "Top
10" Judging Criteria: All "Top 20" Finalists will be required to
participate in a telephone interview with a representative of Disney
Destinations between February 11, 2008 and February 17, 2008 and consent to a
criminal background check. In the event
a "Top 20" Finalist is not available for the telephone interview on the date
and time designated by Sponsor, the "Top 20" Finalist may be disqualified. Based on these interviews, compliance with
applicable Disney appearance guidelines and the results of the criminal
background checks, a total of ten (10) "Top 10" Finalists will be selected from
among all "Top 20" Finalists. The selection
of the "Top 10" Finalists will be made by Disney Destinations whose decisions
are final and binding in all respects relating to the selection of all "Top 10"
Finalists. All "Top 10" Finalists will be required to sign and return an Affidavit
of Eligibility, Liability and Publicity Release. Non-compliance will result in disqualification
of such "Top 10" Finalist and the next highest scoring "Top 20" Finalist may
become a "Top 10" Finalist. Online Voting: All of the
"Top 10" Finalists will be featured at http://www.dreamcmo.com
between 12:00 a.m. ET on March 2, 2008 and 11:59:59 PM ET on March 22, 2008 (the
"Contest Voting Period"). Individuals who go to http://www.dreamcmo.com during
the Contest Voting Period will be asked to view the "Top 10" Finalist Video
Applications and vote for their favorite. Finalist Prize Judging
Criteria: From
among the "Top 10" Finalists, three (3) Finalist Prize Winners will be selected
based on those "Top 10" Finalists who receive the most votes for their Video
Application during the Contest Voting Period. In the event of a
tie, the tied "Top 10" Finalists will be re-judged by an additional
judge selected by CareerBuilder.com who will conduct
a telephone interview with the tied "Top 10" Finalists. In the event a tied "Top 10" Finalist is not
available on the day or time of the telephone interview, that tied "Top 10" Finalist
will be disqualified. Finalist Prize Winners
will be notified by e-mail and U.S. Mail on or about March 23, 2008. Limit one prize per person, per household. Return of a potential Finalist Prize Winner
notification as undeliverable may result in disqualification, and the next
highest scoring "Top 10" Finalist may become a Finalist Prize Winner. A Finalist Prize Winner may decline and
thereby waive his/her right to receive a Finalist Prize. In order to claim a Finalist Prize, Finalist Prize
Winners must be willing to submit to a fingerprint criminal background check (to
be administered by Disney Destinations) and will be required to complete an Affidavit
or Declaration of Eligibility and/or a Release and Waiver and Authorization To
Reproduce Likeness (collectively, the "Documentation"). The Documentation must be returned within ten
(10) business days of receipt of notification containing such Documentation. A potential Finalist Prize Winner's failure
to sign and return the Documentation within ten (10) business days, or to provide
a satisfactory criminal background check or to comply with any term or
condition of these Rules may, at the sole discretion of Sponsor, result in
disqualification, forfeiture of his or her interest in the Finalist Prize, and
the next highest scoring "Top 10" Finalist will become a Finalist Prize Winner.
Except where prohibited by law, a Finalist
Prize Winner's acceptance of a Finalist Prize constitutes permission to use
his/her name, voice/testimonial, hometown, Online Entry and/or
likeness/photograph for promotional, advertising and/or publicity purposes in
any media, now or hereafter known throughout the world in perpetuity, without
further notice or compensation. Finalist Prizes and their Approximate Retail Values ("ARV"): Three (3)
Finalist Prizes: Each Finalist Prize is a trip for the Finalist Prize Winner
and up to three (3) Guests to Walt Disney
World ® Resort near Grand Prize Voting
Period: Individuals who go to http://www.dreamcmo.com
between 12:00 a.m. ET on April 14, 2008 and 11:59:59 PM ET on April 21, 2008,
("Grand Prize Voting Period") will be asked to view the three (3) Grand Prize Video
Applications and vote for their favorite. The Finalist Prize Winner who receives the
highest number of votes during the Grand Prize Voting Period will be deemed the
Grand Prize Winner. "Chief Magic Official
Job": The Grand Prize Winner will be announced in a
ceremony at the Walt Disney World®
Resort on April 22, 2008 and will be offered the job of CMO, a part time
employee of Disney Destinations expected to work between 12 and 32 days during
the Employment Period (as hereinafter defined).
Employment will commence on or about May 1, 2008 and terminate on April
30, 2009 (the "Employment Period"). The
Grand Prize Winner's employment is contingent upon: (1) Grand Prize Winner's completion of the
requisite employment paperwork including, but not limited to, an ideas form, a
confidentiality agreement and a job application; and (2) Grand Prize Winner's
compliance with the "Disney Look". Disney
reserves the right, in its sole discretion, to not hire the Grand Prize Winner
for any reason. The Grand Prize Winner
must also successfully complete certain training including, without limitation,
Media Training and Traditions. The Grand
Prize Winner's sole obligation as CMO will be to travel to those assignments (determined
by Disney Destinations in its sole discretion) between four (4) and eight (8)
times during the Employment Period. It
is currently anticipated that the Grand Prize Winner would be required to attend
the Toy Story Mania Press Event at Disney's
California Adventure from 6/11/08-6/13/08; Mickey's Halloween Time at the Disneyland® Resort from 10/4/08-10/6/08;
the CareerBuilder.com meeting in Chicago from 1/6/09-1/8/09; and an event at Disney's California Adventure from
4/24/09-4/26/09. These events and dates
are subject to change in the sole discretion of Disney Destinations. The Grand Prize Winner must be available to
travel when needed by Disney Destinations.
Each time the Grand Prize Winner travels at the request of Disney
Destinations during the Employment Period, Disney will provide the following to
the Grand Prize Winner: (a) round-trip
coach-class air transportation from the major commercial airport in the US nearest
winner's permanent residence (selected by Disney Destinations) to the airport
designated by Disney Destinations (the "Arrival Airport"), (B) car service
between the Arrival Airport and the location of Grand Prize Winner's assignment
(e.g., the Disneyland® Resort) (c)
hotel accommodations (depending on availability, one standard deluxe room, quad
occupancy) at a hotel designated by Disney Destinations, (d) an hourly rate in
an amount to be determined by Disney Destinations in its sole discretion, for
each hour the Grand Prize Winner acts as the CMO at the request of Disney Destinations and
(e) a spending allowance in an amount to be determined by Disney Destinations
in its sole discretion. The Grand Prize
Winner will also be provided with twenty (20) one (1) day theme park tickets,
in the aggregate, to either the Walt Disney
World® Resort or Disneyland®
Resort. If the Grand Prize Winner
resides within 250 miles of the destination, air transportation will not be
provided. The Grand Prize Winner will
receive no other compensation from Disney Destinations for his/her services as
the CMO. The Grand Prize Winner is solely responsible for any and all ground
transfers between winner's residence and airport of departure, gratuities,
travel upgrades, personal incidentals, all airport and government issued taxes,
and any other expenses not specified herein.
All travel is subject to any and all restrictions instituted by the
Department of Defense and/or Department of Homeland Security at the time of travel. Grand Prize Winner will be solely responsible
for obtaining any and all required travel documents prior to travel and the
associated costs for these requirements. The Released
Parties maintain no control over the personnel, equipment, or operation of any
air carrier or ground transportation carrier and shall not be liable for any
injury, damage, loss, expense, accident, delay, inconvenience, or other
irregularity that may be caused. No
substitution, refund, cash redemption, assignment or transfer of any of the
foregoing compensation permitted. Grand
Prize Winner is solely responsible for all federal, state and local taxes. These Rules do not constitute an employment
agreement. Specifically, Grand Prize
Winner is an at-will employee and his/her employment with Disney Destinations
may be terminated at any time. Participation: Participation in the Contest constitutes an
agreement by each entrant to comply with these Rules. These Rules will be
posted at http://www.dreamcmo.com between January 8, 2008 and April 22, 2008. Sponsor reserves
the right to, in its sole discretion, cancel, modify or suspend the Contest
should any computer virus, bugs or other technical difficulty or other causes
beyond the control of the Sponsor or Released Parties corrupt the
administration, security or proper play of the Contest. Limitations
of Liability: By
entering the Contest, you agree that (1) any and all disputes, claims, and
causes of action arising out of or in connection with the Contest, or any prize
awarded, shall be resolved individually without resort to any form of class
action; (2) any claims, judgments and awards shall be limited to actual
out-of-pocket costs incurred, including costs associated with entering the Contest,
but in no event attorney's fees; and (3) under no circumstances will you be
permitted to obtain any award for, and you hereby waive all rights to claim,
punitive, incidental or consequential damages and any and all rights to have
damages multiplied or otherwise increased and any other damages, other than
damages for actual out-of-pocket expenses. Construction: All issues and questions concerning
the construction, validity, interpretation and enforceability of these Rules,
or the rights and obligations of any entrant vis-ą-vis Sponsor, shall be
governed by, and construed in accordance with the laws of the State of
Illinois, without giving effect to any choice of law or conflict of law rules
or provisions (whether of the State of Illinois, or any other jurisdiction)
that would cause the application of the laws of any jurisdiction other than the
State of Illinois. The invalidity or unenforceability of any provision of these
Rules shall not affect the validity or enforceability of any other provision.
In the event that any provision is determined to be invalid or otherwise
unenforceable or illegal, these Rules shall otherwise remain in effect and be
construed in accordance with their terms as if the invalid or illegal provision
was not contained herein. General
Release: By
entering the Contest, you release and discharge Sponsor and Released Parties
from any liability whatsoever in connection with the Contest or with the
acceptance, possession, use or misuse of any prize including, without
limitation, legal claims, costs, injuries, losses or damages, demands or
actions of any kind (including, without limitation: personal injuries; death;
damage to, loss or destruction of property; rights of publicity or privacy; and
defamation or portrayal in a false light). Sponsor and Released Parties will
not be responsible for typographical, printing or other inadvertent errors in
these Rules or in other materials relating to the CareerBuilder.com Magic Job Contest. Official
